1.  About These Terms

1.1  These Terms of Sale (“Terms”) set out the legally binding terms on which we sell products through loujoia.com (the “Website”).

1.2  Please read these Terms carefully before placing an order. By placing an order you agree to be bound by these Terms.

1.3  These Terms should be read alongside our Privacy Policy and Cookie Policy.

2.  About Us

2.1  The Website is operated by Lou Joia, trading as Lou Joia Marble Candles (“we”, “us”, “our”).

3.  Our Products

3.1  Product descriptions.  Each product is sold subject to its description on the Website.

3.2  Handmade and natural materials.  Our marble vessels are made from natural stone. Colour, veining, texture and pattern will vary from piece to piece. Minor variations and small natural markings are inherent characteristics of the material and are not defects. Product photographs are illustrative only.

3.3  Safety.  Candles must be used responsibly and in line with the safety instructions provided with your product and on the Website. Please refer to Section 11 (Candle Safety) for full guidance.

3.4  Eligibility.  By placing an order, you confirm that you are legally capable of entering into a binding contract and that you are authorised to use the payment method provided.

4.  Placing an Order

4.1  How to order.  You place an order by following the on-screen checkout process. You may review and correct your order before submitting it.

4.2  Acknowledgement versus acceptance.  After you place an order we will email you to acknowledge receipt. This acknowledgement does not mean your order has been accepted.

4.3  When the contract is formed.  A binding contract between you and us is formed when we email you to confirm that your order has been dispatched.

4.4  Refusal or cancellation by us.  We may decline or cancel an order where, for example, stock is unavailable, a pricing error has occurred, payment is not authorised, or we reasonably suspect fraud or resale activity. If we cancel an order after taking payment, we will refund you in full.

5.  Prices, Taxes and Payment

5.1  All prices are displayed in euros (€) and are inclusive of Irish VAT at the applicable rate.

5.2  Delivery charges and any optional service charges are displayed at checkout before you place your order.

5.3  We accept Visa, Mastercard, American Express, Apple Pay and PayPal. Payment is taken at the time your order is placed.

5.4  For deliveries outside Ireland (when available), you may be liable for import duties or taxes charged by the customs authority of the destination country. These charges are your responsibility.

6.  Delivery

6.1  Delivery area.  We currently deliver to addresses in the Republic of Ireland only and do not deliver to P.O. boxes. We may expand delivery to additional European destinations in connection with a future product launch. Any updates, including eligible countries, pricing and timelines, will be published on the Website and will apply only to orders placed after the update.

6.2  Dispatch times.  Ready-to-ship items are typically dispatched within 7 working days of order confirmation.

6.3  Delivery estimates.  Any delivery date or time quoted is an estimate only and is not guaranteed.

6.4  Risk.  Risk of loss or damage to the goods passes to you on delivery to the address you have specified.

6.5  Damaged parcels.  If your order arrives damaged, please contact us at info@loujoia.com within 48 hours of delivery. Please include photographs of: (a) the outer packaging, (b) the inner packaging, (c) the damaged item(s), and (d) the delivery label. Prompt reporting helps us investigate and resolve the issue quickly. Nothing in this clause affects your statutory rights.

7.  Your Right to Cancel (Consumer Cooling-Off Period)

7.1  14-day cancellation right.  If you are a consumer purchasing goods from us online, you have the right to cancel your order within 14 days without giving any reason. The cancellation period expires 14 days after the day on which you, or a person you nominate, acquire physical possession of the goods.

7.2  How to cancel.  To exercise your right to cancel, you must inform us before the cancellation period expires by sending a clear statement to info@loujoia.com. Please include your name, order number and the item(s) you wish to cancel. You may use the optional cancellation template below, but it is not required. We will confirm receipt of your cancellation by email.

7.3  Returning goods after cancellation.  If you cancel after receiving the goods, you must return them to us within 14 days of notifying us of your cancellation. Please contact info@loujoia.com to obtain the return address. You must take reasonable care of the goods while they are in your possession.

7.4  Condition of returned items.  To receive a full refund for a change-of-mind cancellation, items must be returned unused, unburned and undamaged, with all original packaging and inserts where possible. Candles that have been lit or burned cannot be resold; in such cases, any refund may be reduced to €0 to reflect the diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

7.5  Return costs.  Unless we agree otherwise, you are responsible for the direct cost of returning the goods when you cancel for a change of mind. We recommend using a tracked delivery service, particularly given the fragile nature of marble items.

7.6  Refunds.  If you cancel, we will refund all payments received from you, including the cost of standard delivery (but not any additional cost where you chose a delivery option more expensive than our standard offering). We will issue your refund no later than 14 days after we are informed of your decision to cancel. For goods already dispatched, we may withhold the refund until we receive the goods back or you provide evidence that you have returned them, whichever occurs first. Refunds will be made using the same payment method you used for the original transaction, unless you expressly agree otherwise.

7.7  Faulty goods.  Nothing in this Section 7 affects your statutory rights where goods are faulty, misdescribed or not as described.

8.  Faulty Goods and Your Statutory Rights

8.1  If goods are faulty, not as described or do not conform with the contract, you have rights under Irish and EU consumer law (including the Sale of Goods and Supply of Services Act 1980 and the EU Consumer Rights Directive as transposed into Irish law).

8.2  If you believe your product is faulty, please contact us at info@loujoia.com with your order number, a description of the fault and photographs where possible. We will assess the issue and, where appropriate, offer a repair, replacement or refund in accordance with your statutory rights.

8.3  Nothing in these Terms is intended to limit or exclude your statutory rights as a consumer.

9.  Limitation of Liability

9.1  Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any matter for which it would be unlawful for us to exclude or limit liability.

9.2  Subject to clause 9.1, our total liability to you in connection with any order shall not exceed the total price paid by you for that order.

9.3  Subject to clause 9.1, we shall not be liable for any indirect, consequential or incidental loss or damage arising out of or in connection with these Terms or any order.

9.4  We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including (without limitation) natural disasters, strikes, pandemics, transport disruption or supplier failure.

10.  Ownership of Rights

10.1  All content on the Website, including but not limited to text, images, product photography, graphic design, logos, icons, audio, video, software, page layout and underlying code, is owned by or licensed to Lou Joia and is protected by copyright and other intellectual property laws.

10.2  You may view, download and print pages from the Website for your own personal, non-commercial use, provided you do not modify, copy, reproduce, republish, upload, post, transmit, distribute, sell, license or otherwise exploit any content for any commercial or public purpose without our prior written consent.

10.3  All moral rights of the author are asserted and reserved.

11.  Intellectual Property

11.1  The trade marks, logos, service marks and designs (“Intellectual Property”) displayed on the Website are the registered and unregistered marks or designs of Lou Joia and/or our licensors and suppliers, and are protected by Irish, EU and international intellectual property laws.

11.2  You may not use, reproduce, copy, modify or distribute any of our Intellectual Property without our prior written consent, except as strictly necessary for placing and receiving an order or as otherwise required by applicable law.

11.3  If you believe any content on the Website infringes your intellectual property rights, please contact us at info@loujoia.com with details of the alleged infringement.

12.  Prohibited Uses of the Website

12.1  You may use the Website only for lawful purposes. You agree not to use the Website in any way that:

(a)  breaches any applicable local, national or international law or regulation;

(b)  is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

(c)  involves the transmission of unsolicited or unauthorised advertising, promotional material, spam, chain letters or any similar solicitation;

(d)  involves knowingly transmitting any data or uploading any material that contains viruses, Trojan horses, worms, spyware, adware or any other harmful software or code designed to adversely affect the operation of any computer software, hardware or network; or

(e)  involves attempting to gain unauthorised access to, interfere with, damage or disrupt any part of the Website, any server or network on which the Website is hosted, or any software used in its provision.

12.2  You also agree not to reproduce, duplicate, copy or resell any part of the Website in contravention of these Terms.

12.3  Indemnity.  You agree to defend, indemnify and hold us harmless against any loss, damage, cost or expense (including reasonable legal fees) arising from any third-party claim resulting from your breach of this Section 12 or your unlawful use of the Website, including (without limitation) your use of automated software, bots, scrapers or similar data-gathering tools, or any action that places an unreasonable load on our infrastructure.

13.  Submissions and Feedback

13.1  We welcome enquiries and feedback about our products. However, it is our policy to decline unsolicited product suggestions, creative ideas or design concepts.

13.2  Any enquiry, feedback, suggestion, idea or other information you send to us (“Submission”) will be treated as non-confidential and non-proprietary. Subject to our Privacy Policy, by providing a Submission you grant Lou Joia a non-exclusive, royalty-free, worldwide, perpetual and irrevocable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display the Submission in any form, media or technology, whether alone or as part of other works.

13.3  You acknowledge that Submissions may not be returned and that we may use any ideas, concepts or know-how contained in a Submission for any purpose.

13.4  By sending a Submission you represent and warrant that: (a) you own or otherwise hold all necessary rights in the Submission; (b) the Submission does not contain viruses, commercial solicitation, chain letters or spam in any form; and (c) you are not impersonating any person or entity or using a false email address.

13.5  You agree to indemnify and hold us harmless from and against any claim by a third party in respect of rights in any Submission you provide.

14.  Candle Safety

14.1  Always place the candle on a stable, heat-resistant surface away from draughts, other heat sources and flammable materials.

14.2  Never leave a burning candle unattended. Keep candles out of reach of children and pets.

14.3  Trim the wick to approximately 5 mm before each use.

14.4  Do not burn the candle for more than 4 hours at a time. Allow the marble vessel to cool completely before relighting.

14.5  Discontinue use when approximately 10 mm of wax remains in the vessel.

14.6  Marble vessels may become hot during use. Handle with care and do not move a candle while the wax is liquid.

14.7  Lou Joia accepts no liability for damage, injury or loss caused by failure to follow these safety instructions.

15.  Privacy and Data Protection

15.1  We process your personal data in accordance with our Privacy Policy, which is available on the Website. By placing an order, you acknowledge that you have read and understood our Privacy Policy.

15.2  We use cookies on the Website in accordance with our Cookie Policy.

16.  Governing Law and Disputes

16.1  These Terms are governed by and construed in accordance with the laws of Ireland.

16.2  If you are a consumer, you may bring proceedings in the courts of Ireland or in the courts of the EU member state in which you are domiciled. If we wish to enforce any right against you as a consumer, we will do so only in the courts of the jurisdiction in which you are domiciled.

17.  Changes to These Terms

17.1  We may update these Terms from time to time. The version in force at the date you place your order will apply to that order.

17.2  The date at the top of this document indicates when these Terms were last updated.

18.  General

18.1  Entire agreement.  These Terms (together with our Privacy Policy and Cookie Policy) constitute the entire agreement between you and us in relation to your order.

18.2  Severability.  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18.3  Waiver.  A failure by us to exercise or enforce any right under these Terms shall not constitute a waiver of that right.

18.4  Third-party rights.  No person other than you and us shall have any right to enforce any of these Terms.
